The problem is will they have the backbone to make LAUSD enforce this decision., There are many PERB decisions that have not been implemented after parties won them. If it requires taking the district back to court to enforce the decision, UTLA must be for that. As for the hundreds of falsely accused teachers who lost their jobs as a result of these illegal evaluations, hold the district’s feet to the fire. This will not be the only illegality by the district that will come to light.

THE CONCISE VERSION SEE THE PART WHICH STATES THE DISTRICT MUCH COMPENSATE SOME TEACHERS.

UTLA is gratified
that the Public Employment Relations Board has ruled that LAUSD made
illegal changes to the teacher evaluation system. PERB ordered the
District to cease and desist from continued use of the four-level
observation tool that was unilaterally implemented without reaching an
agreement in bargaining with UTLA. This illegal action was taken under
direction of former Superintendent John Deasy.

PERB also ordered the District to cease and desist from:

1. unilaterally implementing policies within the scope of representation.

2. interfering with employees’ right to be represented by their union.

3. interfering with the right of UTLA to represent its members in negotiations.

PERB also ruled that the District must compensate employees for any
financial losses incurred by the implementation of the four-level
observation rating system.

The District has until February 22nd
to appeal the ruling. Both sides are in negotiations on a new agreement
on evaluations. If the District appeals, it can continue using the
four-level system pending the outcome of that appeal.
UTLA is
confident that if there is an appeal, the full PERB board will affirm
the administrative law judge’s decision that the District acted
unlawfully

Had Deasy actually negotiated this in good faith, rather than declare it by fiat in his deplorable, dictatorial style, we would have saved the community (read taxpayers by some) money, time, and grief.

Deasy’s job was to inflict as much damage on LAUSD via waste and missteps (al la Andy Smarick’s roadmap via the Hoover Institute) as possible in order to make talk of further privatization viable. In that one regard, his tenure was a dubious success.
